Terms of Use and Subscription
These Terms govern the BonitaMente mobile application and its associated learning services (the “Service”). The Service is provided by Igor Korolev, acting in his personal capacity as an independent developer (“we”, “us”, or “our”). Contact: support@bonitamente.es.
1. Agreement and eligibility
You must be at least 18 years old and legally able to enter into this agreement. By accepting these Terms, you agree to comply with them when using the Service. If you do not agree, do not use the Service. Mandatory rights available to you as a consumer are not affected.
The license to an application obtained from the App Store is governed by the Apple Standard End User License Agreement. These Terms govern our learning services and content and supplement that agreement. Apple’s agreement prevails on application licensing and marketplace usage rules if there is a conflict.
2. Learning with BonitaMente
BonitaMente offers lessons, videos, learning materials and optional exercises for applying makeup to yourself. Completing or submitting assignments is optional. We may provide feedback on assignments at our discretion, but we are not obliged to review assignments or provide feedback. It is not professional makeup-artist training, an accredited qualification, or a medical service. The content does not diagnose or treat skin conditions and does not replace advice from a qualified healthcare professional.
Results depend on practice, personal characteristics, products and how you apply the lessons. We do not promise a particular appearance or outcome. Follow cosmetic manufacturers’ instructions, warnings and hygiene guidance. Stop using a product if it causes irritation and seek appropriate medical advice. Do not apply a technique or product that is unsuitable for you.
3. Guest access and accounts
Some parts of the Service are available without an account. An account allows you to access account-linked courses and learning records. You may sign in using the supported email or Apple sign-in options. Keep your sign-in credentials confidential, provide accurate information and notify us if you believe your account has been compromised.
Use the email associated with an existing course purchase to access that purchase. A different email address, including an Apple private relay address, does not by itself establish ownership of another account or purchase. Contact support if you need help locating your access rights.
Guest learning records and App Store purchases have different access mechanisms. Keep access to the device and Apple Account used for guest activity or purchases. Signing out, changing an account or deleting local data does not transfer another person’s access rights to you.
4. Free content and paid access
The Service identifies the content available for free and the content requiring paid access. An active BonitaMente membership gives access to the courses included in the membership for its duration. The purchase screen describes the included content, price, currency, billing period and any applicable offer before you confirm a purchase.
Access obtained through an earlier purchase outside the app remains subject to that purchase’s scope and duration. These Terms govern use of the mobile Service but do not replace the original sales terms or expand a course-specific purchase into a membership. Contact support if an existing purchase is missing.
5. App Store subscriptions
BonitaMente offers monthly and annual auto-renewable subscriptions through Apple’s App Store. The amount shown for the selected billing period is charged to your Apple Account when you confirm the purchase. An annual plan is billed annually; a monthly equivalent shown for comparison does not turn it into monthly instalments.
Your subscription renews automatically unless you cancel it before the renewal deadline shown by Apple. To avoid the next renewal, turn off renewal at least 24 hours before the current period ends. Apple may charge for renewal within the 24 hours before the end of that period. Any trial, introductory offer or price change is governed by the terms presented at purchase and Apple’s applicable notice and consent requirements.
You can manage or cancel an App Store subscription in your Apple Account subscription settings, including through the subscription-management option in the app. Cancellation stops future renewal; access normally continues until the end of the paid period, subject to refunds or other lawful revocation. Deleting the app or your BonitaMente account does not cancel an Apple subscription.
Use the app’s restore-purchases option with the Apple Account used for the purchase to restore eligible access. Restoration does not create a new purchase. An expired, refunded or revoked subscription does not provide an active entitlement.
6. Refunds and consumer rights
Apple handles billing and refund requests for App Store purchases. You can request a refund through Apple’s purchase-support service. Eligibility and processing follow Apple’s procedures and applicable law. BonitaMente does not offer an additional voluntary money-back guarantee.
Nothing in these Terms removes any mandatory right to withdraw, cancel, receive a refund or obtain a remedy for digital content or services that do not conform to the contract. Where the law permits loss of a withdrawal right for immediately supplied digital content, this requires the legally required express consent and acknowledgement; acceptance of these Terms alone is not a blanket waiver.
7. Your assignments, photos and feedback
You retain ownership of the text, photos and other material you submit. You give us a non-exclusive permission, limited to operating the Service, to store, reproduce, display to you and authorised reviewers, and process that material to deliver lessons, assess assignments and respond to your requests. This permission does not authorise use of your photos in advertising or public promotion.
Submit only material you have the right to provide. Obtain permission from anyone identifiable in it. Do not submit unlawful material, intimate images, confidential third-party information or medical records. Assignment feedback is educational and is not medical advice.
8. Permitted use and intellectual property
You may use the Service and its materials for your personal, non-commercial learning within your access rights. Our software, brand, course materials and original content belong to us or the relevant rights holders. No ownership in them is transferred to you.
You must not share or sell access credentials; republish, distribute or commercially exploit course materials without permission; bypass access controls; interfere with security or availability; upload malicious material; impersonate another person; or infringe another person’s privacy or intellectual-property rights. These restrictions do not limit uses that applicable law permits and that cannot lawfully be excluded.
9. Privacy and external services
The Privacy Policy explains how we process personal data and use providers for payments, sign-in, video delivery, diagnostics, hosting and support. Access to external services is also subject to their applicable terms. We remain responsible for our own legal obligations.
10. Changes, availability and termination
We may provide updates and make changes needed to maintain, secure or improve the Service or comply with law. We will not use this provision to remove mandatory consumer rights or avoid obligations for paid content. Material changes affecting paid access will receive the notice and remedies required by law.
We may restrict access where reasonably necessary to address a material breach, unlawful use or a security risk. Measures will be proportionate; where appropriate and legally required, we will explain the reason and give an opportunity to resolve the issue. You may stop using the Service and request deletion as explained in Account and Data Deletion.
11. Responsibility
We take reasonable care in providing the Service but do not guarantee uninterrupted availability or that every item is free from error. To the extent permitted by law, we are not responsible for losses caused by misuse, unauthorised account access attributable to a failure to protect credentials, or circumstances beyond our reasonable control.
Nothing excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, breach of mandatory data-protection duties, or any liability that cannot lawfully be excluded or limited. Statutory guarantees and remedies remain available.
12. Applicable law, changes to these Terms and contact
Applicable law and jurisdiction are determined by the mandatory rules applying to the parties and the dispute. You retain the mandatory consumer protections and access to courts available under the law applicable to you. Contact us first if you would like us to help resolve a concern.
We may update these Terms for changes in the Service or legal requirements. The version and publication date appear on this page. Material changes affecting your rights will receive additional notice where required, and renewed acceptance will be sought where necessary. Changes do not retrospectively remove accrued rights.
